By engaging our services, you agree to the following Terms and Conditions. Please read carefully.
Terms & Conditions
1. Services Provided
JD Lawn Care QLD provides lawn mowing, edging, whipper snipping, hedging, pruning, garden maintenance, weed treatment, garden clean-ups, green waste removal and garden improvement services.
Garden improvement services may include:

Mulching and re-mulching
-
Decorative stone and gravel installation
-
Sandpit and play-area sand refills
-
Garden edging
-
Stepping stones and pathways
-
Planting and garden bed improvements
-
Minor outdoor property refreshes
The specific services included in each job will be outlined in the accepted quote, invoice, written correspondence or service agreement.
Any additional work requested outside the agreed scope must be approved before commencement and may incur additional charges.
2. Quotes and Scope of Work
Services are generally quoted on a case-by-case basis, with a fixed price provided before work begins. Hourly, daily or scheduled maintenance rates may apply where agreed.
Quotes are based on the information, photographs, measurements and property conditions available at the time.
The quoted price or scope may be revised where:

The property condition differs significantly from what was shown or described
-
Additional labour, materials, equipment or disposal is required
-
Hidden obstacles, extensive roots or concealed waste are discovered
-
Access is more difficult than reasonably anticipated
-
The client requests additional work
-
The amount of green waste exceeds the original allowance
-
Measurements or quantities supplied by the client are inaccurate
-
Unforeseen site conditions affect the work
Any significant variation will be discussed with the client before additional work proceeds.
Quotes remain valid for the period stated on the quote. Where no expiry period is stated, the quote will remain valid for 30 days.
3. Acceptance of Quote and Terms
A client accepts the quote and these Terms and Conditions by:

Accepting a quote electronically or in writing
-
Confirming a booking by email, text message or phone
-
Paying a deposit
-
Providing access for work to commence
-
Signing a service agreement
-
Continuing with an agreed recurring service after receiving these terms
The accepted quote, these Terms and Conditions and any approved written variations together form the agreement for the service.
4. Service Area
Services are primarily provided throughout the Gold Coast and surrounding areas unless otherwise agreed.
Travel or call-out charges may apply for properties outside JD Lawn Care QLD’s usual service area.
Any applicable travel or call-out charge will be disclosed before the booking is confirmed.
5. Pricing and GST
Pricing will be clearly outlined and agreed upon before work begins.
All consumer-facing advertised prices will include GST where GST applies. Quotes and invoices may display the price as a subtotal, GST amount and total payable.
The total price payable will be clearly shown before the client accepts the service.
Quotes may separately include:

Labour
-
Materials
-
Delivery charges
-
Equipment hire
-
Green waste removal
-
Tip and disposal fees
-
Travel charges
-
Other agreed expenses
Australian pricing rules generally require displayed consumer prices to show the total payable price, including GST and unavoidable fees.
6. Deposits and Upfront Payments
Larger jobs may require a deposit before work commences.
Unless otherwise stated in the quote, the required deposit will generally be 30% of the total quoted price.
Where a job requires materials, delivery, equipment hire or specially ordered products, JD Lawn Care QLD may require:

Material and delivery costs to be paid in full before ordering
-
A deposit toward labour and reserved booking time
-
Progress payments for jobs completed over multiple days or stages
The required deposit and payment schedule will be stated in the quote before acceptance.
Deposits will be applied toward the total price of the job.
Where the client cancels after materials have been ordered, equipment has been hired or other non-recoverable costs have been incurred, JD Lawn Care QLD may retain the portion of the deposit reasonably required to cover those costs.
Any remaining refundable amount will be returned to the client.
Nothing in this section limits any rights that cannot legally be excluded under the Australian Consumer Law.
7. Materials
Materials will generally not be ordered until the required deposit or upfront payment has been received.
Natural materials such as mulch, decorative stone, gravel, soil, sand, turf and plants may vary in colour, shape, size, texture and appearance.
JD Lawn Care QLD is not responsible for reasonable natural variations between samples, photographs and supplied materials.
Material quantities included in a quote are based on JD Lawn Care QLD’s estimated requirements for completing the agreed scope of work.
Unless otherwise expressly agreed in writing, the client is purchasing the completed service and agreed result rather than a specific quantity of unopened or unused materials.
Any surplus or unused materials purchased or supplied by JD Lawn Care QLD remain the property of JD Lawn Care QLD.
JD Lawn Care QLD may, at its discretion, leave suitable surplus materials onsite for the client. The client does not have an automatic entitlement to unused materials unless the quote specifically states that a particular quantity of material is being sold directly to the client.
Where the client independently purchases and supplies materials for the job, any unused client-supplied materials will remain the client’s property.
8. Invoicing and Payment
Invoices will generally be issued upon completion unless another arrangement has been agreed.
Payment is due on the day of service or within 48 hours of completion unless different payment terms are stated on the quote, invoice or service agreement.
Commercial clients, body corporates, property managers and approved account clients may be offered alternative payment terms in writing.
Clear written payment terms help establish when payment is due and reduce payment disputes.
9. Payment Methods
Payment may be made by:

Bank transfer
-
Card or online payment
-
Cash, where agreed
-
Another approved payment method shown on the invoice
Any card or online payment surcharge will be disclosed before payment and will not exceed JD Lawn Care QLD’s applicable cost of accepting that payment method.
10. Overdue Accounts
Invoices remaining unpaid seven days after the due date may incur a $15 overdue administration fee, provided the fee was disclosed before the service was accepted.
The overdue administration fee will not ordinarily be charged more than once for the same invoice unless a different arrangement has been expressly agreed in writing.
JD Lawn Care QLD may:

Suspend future or recurring services
-
Decline further bookings
-
Require upfront payment for future work
-
Refer significantly overdue accounts for debt recovery
The client may also be responsible for reasonable debt-recovery expenses actually incurred by JD Lawn Care QLD, where legally recoverable.
Any overdue fee or recovery charge will be applied reasonably and proportionately. Australian law prohibits unfair terms in applicable standard-form consumer and small-business contracts.
11. Cancellations and Rescheduling
Clients are requested to provide at least 24 hours’ notice when cancelling or rescheduling a booking.
A cancellation made with less than 24 hours’ notice may incur a cancellation fee of up to $50 where:

Time was specifically reserved
-
Travel had commenced
-
Workers had been scheduled
-
Equipment had been hired
-
Materials had been prepared
-
Other reasonable costs had already been incurred
Where a deposit has been paid, JD Lawn Care QLD may retain the portion reasonably required to cover committed materials, delivery, equipment hire, labour or other non-recoverable costs.
No cancellation fee will ordinarily apply where JD Lawn Care QLD agrees that the cancellation resulted from circumstances reasonably outside the client’s control.
Cancellation charges will be applied reasonably and not as an excessive penalty.
12. Recurring Maintenance
Recurring services may be arranged weekly, fortnightly, every three weeks, monthly or at another agreed frequency.
Recurring maintenance pricing is based on the property being serviced at the agreed interval.
Where a visit is cancelled, skipped or significantly delayed, increased growth or deterioration may require:

Additional labour
-
A revised service price
-
An initial clean-up charge
-
The work to be booked as a separate one-off service
The original recurring maintenance price may not apply where the period between visits extends significantly beyond the agreed schedule.
Either party may discontinue recurring services by providing reasonable notice.
The client remains responsible for all completed services and approved costs already committed.
13. Property Access
Clients must provide safe and unobstructed access to all agreed work areas on the scheduled service date.
The client is responsible for:

Unlocking gates and access points
-
Providing gate codes or entry instructions
-
Securing dogs and other animals
-
Moving vehicles that prevent access
-
Advising tenants, occupants or site managers of the booking
-
Identifying irrigation, lighting cables, pipes and underground services
-
Advising JD Lawn Care QLD of known hazards or restricted areas
Where access cannot be obtained, the service may be rescheduled and a reasonable call-out or cancellation fee may apply.
14. Site Preparation
Before the scheduled service, clients must remove or secure:

Pet waste
-
Toys
-
Garden hoses
-
Loose tools
-
Furniture
-
Fragile ornaments
-
Electrical cords
-
Personal belongings
-
Other movable objects within the work area
JD Lawn Care QLD may work around items left onsite. Areas that cannot be safely or reasonably accessed may be excluded from the service.
Additional labour required to move excessive items, remove obstacles or clear access may incur an additional charge where approved.
15. Pet Waste Fee
Clients must remove all dog faeces and other animal waste from lawns, gardens and access paths before JD Lawn Care QLD arrives.
Where animal waste has not been removed and JD Lawn Care QLD must collect, avoid, handle or clean equipment because of the waste, a $50 pet waste fee may be charged.
JD Lawn Care QLD may refuse to service heavily contaminated areas and may reschedule the work until the area has been cleaned.
The fee may still apply where time has been lost, work has been disrupted or equipment cleaning has been required.
16. Children, Pets and Other Persons
Children, pets and other persons must remain safely clear of active work areas and operating equipment.
JD Lawn Care QLD may pause or cease work where people or animals repeatedly enter an active work zone and create a safety risk.
Clients must follow any temporary access restrictions advised after weed treatment, fertilisation or chemical application.
17. Weather and Unforeseen Conditions
Services may be postponed, shortened or rescheduled due to:

Heavy rain
-
Lightning or storms
-
Extreme heat
-
Saturated or unsafe ground
-
High winds
-
Fire or emergency warnings
-
Conditions likely to damage the property
-
Equipment breakdown
-
Circumstances outside JD Lawn Care QLD’s reasonable control
JD Lawn Care QLD will make reasonable efforts to provide the next suitable appointment but cannot guarantee a particular rescheduled date.
Weather-related rescheduling initiated by JD Lawn Care QLD will not ordinarily incur a cancellation fee.
18. Green Waste and Disposal Fees
Green waste removal is only included where specifically stated in the quote, invoice or service description.
Where green waste removal is requested or required, a minimum green waste removal fee of $45.00 applies.
The final green waste fee may be higher depending on:

The amount and type of waste
-
Loading and handling time
-
Travel to an approved disposal facility
-
Tip or disposal charges
-
Trailer capacity
-
The number of disposal trips required
-
Whether the waste contains heavy, dense or difficult-to-handle material
Where green waste removal is not included, waste may be placed neatly onsite in an agreed location.
Green waste volume estimates may change after vegetation has been cut, compacted or removed from garden beds.
Additional disposal, labour or travel charges may apply where the actual volume substantially exceeds the original allowance. JD Lawn Care QLD will seek approval before incurring a significant additional charge where reasonably possible.
JD Lawn Care QLD does not remove the following unless specifically agreed and lawfully arranged:

Asbestos
-
Chemicals
-
Hazardous waste
-
Contaminated soil
-
Medical waste
-
Regulated materials
-
Large quantities of household rubbish
-
Building or demolition waste
19. Weed Treatment and Chemicals
Weed treatment may involve manual removal, spot spraying, blanket spraying or another agreed method.
Results may vary due to:

Weed species
-
Growth stage
-
Weather conditions
-
Irrigation
-
Soil conditions
-
Product resistance
-
Follow-up maintenance
Multiple treatments may be required, and complete eradication is not guaranteed.
Clients must advise JD Lawn Care QLD of:
-
Pets and children
-
Sensitive plants
-
Vegetable gardens
-
Ponds and waterways
-
Known allergies or chemical sensitivities
-
Other environmental concerns
Treated areas must not be accessed for the period advised following application.
20. Lawn, Plant and Garden Outcomes
JD Lawn Care QLD cannot guarantee the continued health, survival or appearance of lawns, turf, plants or garden areas where outcomes are affected by:

Weather
-
Heat or drought
-
Excessive rain
-
Poor drainage
-
Pests or disease
-
Existing soil conditions
-
Irrigation issues
-
Animals
-
Foot traffic
-
Improper watering
-
Inadequate ongoing maintenance
-
Actions taken by the client or another contractor
Any watering, aftercare or maintenance recommendations provided by JD Lawn Care QLD remain the client’s responsibility to follow.
21. Irrigation and Underground Services
Clients must disclose the known location of:

Irrigation systems
-
Pop-up sprinklers
-
Garden lighting
-
Electrical cables
-
Water pipes
-
Drainage systems
-
Septic systems
-
Internet or telecommunications cables
-
Other underground or concealed services
JD Lawn Care QLD is not responsible for damage to concealed, unmarked, incorrectly installed or insufficiently protected services that could not reasonably have been identified before work commenced.
22. Damage, Breakages and Existing Conditions
JD Lawn Care QLD will take reasonable care while carrying out services.
However, subject to rights that cannot legally be excluded, JD Lawn Care QLD is not responsible for damage caused by:

Hidden or incorrectly installed underground services
-
Unmarked irrigation, cables or pipes
-
Fragile, deteriorated or previously damaged fixtures
-
Objects concealed by grass, soil, mulch or vegetation
-
Loose stones, wire, glass or debris within mowing areas
-
Unsafe or defective structures
-
Existing damage
-
Conditions not disclosed before work commenced
Clients should remove or identify fragile, valuable or easily damaged items before work begins.
Nothing in these Terms and Conditions excludes, restricts or modifies any consumer guarantee or right that cannot lawfully be excluded under the Australian Consumer Law.
23. Flying Debris and Loose Objects
Mowing, edging, whipper snipping and garden work can cause hidden or loose objects to become airborne.
Clients must remove stones, toys, wire, glass, metal, irrigation fittings and other loose objects before service.
JD Lawn Care QLD will take reasonable precautions but cannot guarantee that every concealed object will be detected.
24. Safety and Right to Refuse Work
JD Lawn Care QLD may refuse, postpone or stop work where conditions are:

Unsafe
-
Unlawful
-
Outside the agreed scope
-
Beyond available equipment or qualifications
-
Likely to cause unreasonable damage
-
A risk to workers, occupants, animals or members of the public
This may include:
-
Electrical hazards
-
Aggressive animals
-
Asbestos or hazardous substances
-
Unstable structures
-
Unsafe trees or branches
-
Excessive heights
-
Dangerous access
-
Severe weather
-
Heavily contaminated areas
The client remains responsible for work already completed and reasonable costs already incurred.
25. Tree and High-Access Work
JD Lawn Care QLD only undertakes pruning and vegetation work that can be completed safely using available equipment and within the business’s service scope.
Work involving large trees, unstable branches, powerlines, specialist climbing, elevated work platforms or arboricultural expertise may be declined or referred to a suitably qualified contractor.
26. Completion and Inspection
Clients should inspect completed work as soon as reasonably possible.
Any concern regarding the agreed scope or workmanship should be reported within 48 hours of completion, with photographs where appropriate.
JD Lawn Care QLD must be given a reasonable opportunity to inspect and, where appropriate, rectify the concern before another contractor is engaged.
The 48-hour notification request does not remove any rights the client may have under the Australian Consumer Law.
27. Workmanship and Consumer Guarantees
JD Lawn Care QLD will perform services with due care and skill and in accordance with the agreed scope.
Where no completion time has been specifically agreed, services will be completed within a reasonable time, subject to weather, access, material availability and other circumstances outside JD Lawn Care QLD’s reasonable control.
Australian Consumer Law includes consumer guarantees relating to services, including that services be supplied with due care and skill.
Nothing in these Terms and Conditions excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded.
28. Insurance
JD Lawn Care QLD maintains appropriate business insurance.
Evidence of current insurance may be provided upon reasonable request.
29. Employees, Assistants and Subcontractors
JD Lawn Care QLD may use employees, assistants or appropriately qualified subcontractors to complete all or part of the agreed service.
JD Lawn Care QLD remains responsible for managing the agreed scope unless otherwise stated in writing.
30. Photographs and Marketing
JD Lawn Care QLD may take before-and-after photographs for:

Job records
-
Quoting and documentation
-
Quality control
-
Business promotion
-
Social media and website content
Property addresses, client names and identifying personal information will not intentionally be published without permission.
Clients may request before or during the service that photographs of their property not be used for marketing.
31. Privacy
Client information may be used for:
-
Preparing quotes
-
Scheduling services
-
Providing services
-
Issuing invoices
-
Processing payments
-
Maintaining business records
-
Communicating about current or future services
Client information will not be sold or unnecessarily disclosed to third parties.
Information may be provided to accountants, payment providers, insurers, debt-recovery providers or government authorities where reasonably required for business administration or legal compliance.
32. Complaints and Disputes
Clients should contact JD Lawn Care QLD promptly regarding any concern.
Both parties agree to make a reasonable attempt to resolve a dispute through direct discussion before commencing formal recovery or legal action.
Nothing in this section prevents either party from exercising any legal right or contacting an appropriate consumer, regulatory or dispute-resolution body.
33. Amendments
JD Lawn Care QLD may update these Terms and Conditions from time to time.
The version supplied or made available when a service is accepted will apply to that service.
Significant changes affecting recurring clients will be communicated before taking effect.
